Terms & Conditions

RARECRUISE TERMS AND CONDITIONS

These Terms & Conditions apply to all cruise packages and travel arrangements booked through Rarecation Travel Sdn. Bhd. (the “Agency”).

By making a booking, payment, or confirmation, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions.

1. Agency Status and Relationship

1.1 Rarecation Travel acts solely as an authorised sales representative and intermediary for cruise lines, airlines, hotels, transportation providers, and other travel service providers.

1.2 The contract of carriage for the cruise voyage (the “Passage Contract”) is strictly between the Customer and the Cruise Line.

1.3 Rarecation Travel is not a carrier and does not own, operate, manage, or control any cruise vessel, airline, hotel, ground transportation service, or other supplier services.

1.4 Rarecation Travel shall not be responsible or liable for the acts, omissions, delays, operational decisions, insolvency, bankruptcy, or service failures of any cruise line, airline, hotel, transportation provider, or other third-party supplier.

2. Incorporation of Third-Party Supplier Terms

2.1 Application of Supplier Terms

Rarecation Travel acts as an intermediary in arranging travel services provided by independent third-party suppliers. By submitting, confirming, or paying for a booking through Rarecation Travel, the Customer acknowledges and agrees that the booking is also subject to the applicable terms and conditions, policies, rules, and contractual requirements of each relevant third-party supplier (“Supplier Terms”).

2.2 Third-Party Suppliers

Third-party suppliers may include, without limitation:

a) cruise lines and cruise operators;

b) airlines and other air carriers;

c) hotels, resorts, and accommodation providers;

d) ground transportation providers, including transfer, coach, rail, taxi, and car-rental providers;

e) tour operators, excursion providers, and activity providers;

f) port authorities, terminal operators, local operators, and destination service providers; and

g) any other supplier involved in providing part of the Customer’s travel arrangements.

2.3 Customer’s Responsibility to Review Supplier Terms

The Customer is responsible for reviewing and complying with the applicable Supplier Terms before travel. Supplier Terms may be made available through the relevant supplier’s website, booking confirmation, ticket, voucher, travel document, or upon request from Rarecation Travel.

Where a booking is confirmed, the Customer is deemed to have accepted the relevant Supplier Terms, including any requirements relating to payment, identification and travel documents, visas, health declarations, insurance, check-in, boarding, safety, baggage, passenger conduct, cancellation, refunds, and travel restrictions.

2.4 Matters Governed by Supplier Terms

Supplier Terms govern all matters relating to the provision and operation of the relevant supplier’s services, including, without limitation:

a) cruise itineraries, ports of call, embarkation and disembarkation arrangements, and itinerary changes;

b) flight schedules, airline operational changes, delays, cancellations, denied boarding, and baggage rules;

c) hotel check-in and check-out requirements, accommodation availability, and property rules;

d) safety, security, health, immigration, port, and regulatory requirements;

e) boarding procedures, passenger eligibility, required travel documents, and refusal of carriage;

f) cancellation, amendment, refund, rebooking, no-show, and forfeiture policies;

g) baggage allowances, restricted items, loss, delay, or damage to baggage;

h) passenger conduct, code of conduct, and the supplier’s right to refuse, suspend, or terminate services; and

i) any operational decision, disruption, force majeure event, or service limitation affecting the supplier’s services.

2.5 Changes to Supplier Terms

Third-party suppliers may amend their terms, policies, schedules, itineraries, fares, fees, and operating requirements at any time. Such changes are outside Rarecation Travel’s control. The Customer remains responsible for complying with the Supplier Terms in force at the relevant time.

Where Rarecation Travel receives notice of a material change from a supplier, it will use reasonable efforts to inform the Customer. However, Rarecation Travel shall not be responsible for any loss, cost, delay, inconvenience, or disruption arising from a supplier’s amendment or enforcement of its Supplier Terms, except where such liability cannot lawfully be excluded.

2.6 Priority of Supplier Terms

If there is any inconsistency or conflict between these Agency Terms and the Supplier Terms, the Supplier Terms shall prevail to the extent that the matter relates to the relevant supplier’s services, including the operation, carriage, accommodation, cancellation, refund, safety, and conduct requirements of that supplier.

These Agency Terms shall continue to apply to the separate booking, administrative, and agency services provided by Rarecation Travel.

2.7 No Variation of Supplier Terms

Rarecation Travel does not have authority to amend, waive, or override any Supplier Terms unless expressly confirmed in writing by the relevant supplier. Any statement, representation, or assistance provided by Rarecation Travel is subject to the Supplier Terms and shall not alter the contractual rights or obligations between the Customer and the relevant supplier.

3. Booking Confirmation and Payments

3.1 Booking Request, Payment, and Confirmation

A booking request becomes binding upon the Customer’s payment of the required deposit, instalment, or full booking amount, whichever is applicable. Upon receipt of any payment, the Customer confirms acceptance of these Terms and Conditions, the applicable Supplier Terms, and the non-refundable payment policy.

The Customer may be required to provide passports, identification, visas, health declarations, or other travel documents after payment. The absence, delay, rejection, expiry, or incompleteness of such documents does not cancel the Customer’s payment obligation and does not entitle the Customer to cancel the booking for a refund.

Rarecation Travel may only issue final tickets, vouchers, cruise documents, or other travel documents after receiving all required information and documents. However, the booking remains subject to supplier availability and acceptance until the relevant supplier issues its confirmation.

If the Customer fails to provide complete and valid documents by the deadline specified by Rarecation Travel or the relevant supplier, Rarecation Travel may cancel or release the booking, and all payments made shall remain strictly non-refundable, except where a refund is required by applicable law.

Rarecation Travel shall not be liable for any loss, delay, denied boarding, visa refusal, refusal of carriage, cancellation, or other consequence arising from the Customer’s failure to provide accurate, complete, valid, or timely travel documents.

3.2 Payment Deadlines

The Customer must make all payments in full by the payment deadlines stated in the invoice, booking confirmation, or otherwise communicated by Rarecation Travel. Time is of the essence in respect of all payment deadlines.

If any payment is not received by the applicable deadline, Rarecation Travel may, without prior notice:

a) cancel, release, or reduce the reservation;

b) treat the booking as cancelled by the Customer;

c) impose any applicable late-payment, reinstatement, or supplier charges; and/or

d) retain all payments already made in accordance with Clause 3.5.

Rarecation Travel shall not be responsible for any loss of reservation, fare, availability, promotional offer, or travel arrangement resulting from late or incomplete payment.

3.3 Prices and Availability Before Confirmation

Until a booking is confirmed and the required payment has been received, all prices, taxes, port charges, fuel surcharges, exchange rates, promotions, cabin categories, flight seats, hotel rooms, and travel arrangements remain subject to change or withdrawal without prior notice.

Rarecation Travel does not guarantee that any quotation, fare, promotion, itinerary, cabin, seat, room, or other travel arrangement will remain available until the booking has been confirmed.

If a supplier changes the price or terms before confirmation, the Customer may be required to pay the revised amount in order to proceed with the booking. If the Customer does not accept the revised amount, the booking request may be cancelled. Any payment already made shall remain subject to Clause 3.5.

3.4 Promotional and Special Fares

Certain promotional fares, early-bird offers, flash sales, group fares, discounted packages, supplier offers, and limited-availability bookings may require immediate payment in full. Such fares may be strictly non-refundable, non-transferable, non-changeable, or subject to additional supplier restrictions.

The Customer is responsible for reviewing and accepting all applicable fare rules and Supplier Terms before making payment. Once payment has been made, the Customer shall be bound by those conditions.

3.5 Strict Non-Refundable Payment Policy

Except where a refund is expressly required under applicable law, all payments made by the Customer to Rarecation Travel in connection with a booking are strictly non-refundable.

This includes, without limitation:

a) deposits;

b) full payments and instalment payments;

c) cruise fares, airline fares, hotel payments, tour payments, transfer payments, and other supplier-service payments;

d) taxes, port charges, surcharges, fuel charges, and currency-conversion differences;

e) administrative, service, consultation, handling, booking, processing, amendment, and payment-processing fees; and

f) any amount paid following a booking amendment, upgrade, rebooking, or reinstatement.

This non-refundable policy applies regardless of the reason for cancellation, non-travel, withdrawal, delay, denial of boarding, missed departure, missed connection, illness, injury, change of personal circumstances, visa refusal, passport issue, failure to obtain required documents, or no-show by the Customer or any travelling person.

3.6 Supplier Cancellations, Changes, and Refunds

All supplier services are subject to the relevant supplier’s cancellation, amendment, refund, and operational policies. Rarecation Travel does not control whether a supplier permits a cancellation, provides a credit, changes an itinerary, or issues any refund.

If a supplier cancels or materially changes a service, Rarecation Travel will use reasonable efforts to assist the Customer in submitting a request to the supplier. However, Rarecation Travel does not guarantee that any refund, credit, rebooking, compensation, or alternative arrangement will be offered or approved by the supplier.

Any refund, credit, or compensation is strictly subject to the supplier’s written approval, its applicable terms, and applicable law. Rarecation Travel may deduct any non-refundable fees, charges, or amounts that it is entitled to retain before passing on any supplier-approved refund or credit.

3.7 No Cash Refund for Customer Cancellation

Where the Customer cancels a confirmed booking, Rarecation Travel is under no obligation to provide a cash refund, credit, transfer, or substitute travel arrangement, except where required by applicable law or expressly approved in writing by Rarecation Travel and the relevant supplier.

Any goodwill credit, rebooking assistance, or alternative arrangement offered by Rarecation Travel shall be entirely discretionary and shall not create a precedent or entitlement for the Customer.

3.8 Payment Authorisation

By making payment, the Customer confirms that the Customer has read, understood, and accepted this non-refundable payment policy, the relevant supplier Terms, and all applicable booking conditions. The Customer further confirms that the payment is authorised and that Rarecation Travel may apply the payment towards the relevant booking, supplier charges, and applicable fees.

4. Payment Fraud and Chargeback Protection

4.1 Payment Authority and Customer Confirmation

By making or authorising any payment to Rarecation Travel, the Customer confirms and warrants that:

a) the Customer is the lawful and authorised holder of the payment card, bank account, e-wallet, or other payment method used;

b) where the payment method belongs to another person, the Customer has obtained that person’s express authority to make the payment and enter into the booking;

c) all payment, billing, identity, contact, and booking information provided to Rarecation Travel is true, accurate, complete, and current; and

d) the Customer is authorised to accept these Terms and Conditions on behalf of all travellers included in the booking.

Rarecation Travel may require the Customer to provide reasonable evidence of payment authorisation, identity, relationship to the cardholder, or other verification documents before processing, confirming, ticketing, or releasing a booking.

4.2 Fraud Prevention and Verification

Rarecation Travel reserves the right to carry out reasonable payment-security, fraud-prevention, and identity-verification checks at any time.

If Rarecation Travel reasonably suspects that a payment, booking, or supporting document is unauthorised, fraudulent, suspicious, or inconsistent with the information provided, Rarecation Travel may, without liability:

a) place the booking on hold;

b) decline or reverse the payment;

c) request additional verification or supporting documents;

d) delay confirmation, ticketing, or issuance of travel documents;

e) cancel or release the booking; and/or

f) report the matter to the relevant payment provider, financial institution, supplier, authority, or law-enforcement body where appropriate.

Rarecation Travel shall not be liable for any price change, loss of availability, cancellation, delay, or other loss arising from a fraud-prevention or verification process.

4.3 Customer Duty to Raise Concerns Directly

If the Customer has any question, complaint, concern, or dispute regarding a payment, invoice, charge, booking, cancellation, refund, or service arrangement, the Customer agrees to contact Rarecation Travel first and provide a reasonable opportunity for the matter to be reviewed and addressed.

The Customer should provide the relevant booking reference, payment details, and supporting information when raising a concern. Rarecation Travel will use reasonable efforts to investigate and respond within a reasonable period.

Nothing in this clause prevents the Customer from exercising any right to raise a genuine payment dispute with a financial institution or other authority where such right cannot lawfully be restricted.

4.4 Chargebacks and Payment Disputes

Before initiating a chargeback, payment reversal, or dispute with a bank, card issuer, payment processor, or e-wallet provider, the Customer agrees to first contact Rarecation Travel in accordance with Clause 4.3, except where urgent action is reasonably necessary to prevent fraud or comply with applicable law.

A chargeback or payment dispute does not automatically cancel the Customer’s obligations under these Terms, including any outstanding payment obligations, cancellation charges, supplier charges, or non-refundable amounts.

Where a chargeback is initiated after a booking has been confirmed, travel documents have been issued, supplier services have been reserved, or services have been used, Rarecation Travel may suspend further services, cancel outstanding arrangements, or withhold travel documents to the extent permitted by applicable law and Supplier Terms.

4.5 Disclosure of Records for Disputes

Where a payment dispute, chargeback, fraud investigation, or verification request arises, Rarecation Travel reserves the right to provide relevant records to the applicable bank, card issuer, payment processor, e-wallet provider, supplier, insurer, legal adviser, regulator, or authority.

Such records may include, without limitation:

a) booking forms, booking confirmations, invoices, receipts, and payment records;

b) correspondence by email, messaging application, telephone, or other communication channels;

c) proof of acceptance of these Terms and Conditions and Supplier Terms;

d) identity-verification documents and payment-authorisation evidence;

e) travel documents, ticketing records, boarding or usage records, and supplier confirmations; and

f) any other information reasonably required to investigate, defend, or resolve the dispute.

Rarecation Travel will handle personal data in accordance with its applicable privacy obligations and applicable law.

4.6 Fraudulent or Abusive Disputes

Where Rarecation Travel reasonably determines that a chargeback, payment dispute, cancellation request, or claim is fraudulent, knowingly false, abusive, vexatious, or inconsistent with these Terms and Conditions, Rarecation Travel reserves all rights available to it under applicable law.

This may include the right to recover reasonable losses, charges, and costs incurred as a direct result of the matter, including:

a) bank, card-processor, and chargeback fees;

b) supplier cancellation, reversal, or reinstatement charges;

c) reasonable administrative and investigation costs;

d) reasonable debt-recovery, legal, and professional-adviser costs; and

e) any outstanding booking amount or other sum lawfully due to Rarecation Travel.

4.7 No Waiver of Rights

Rarecation Travel’s decision to investigate, assist with, or respond to a payment dispute shall not be treated as an admission of liability, a waiver of its rights, or an agreement to provide a refund.

All rights and remedies of Rarecation Travel are reserved.

4.8 Supplier, Onboard, and In-Trip Charges

During the trip, the Customer may purchase or incur charges directly with a cruise line, airline, hotel, shore excursion operator, onboard retailer, port operator, local operator, or other third-party supplier. These charges may include, without limitation, onboard purchases, shore excursions, Wi-Fi or internet packages, dining, beverages, gratuities, spa services, retail items, entertainment, laundry, baggage charges, transportation, optional activities, and other incidental services.

The Customer is responsible for reviewing all receipts, invoices, account statements, onboard folios, and charges issued by the relevant supplier. If the Customer believes that a supplier has charged an incorrect, duplicate, excessive, unauthorised, or otherwise disputed amount, the Customer must raise the matter directly with that supplier as soon as possible and, where applicable, before disembarkation, check-out, or completion of the relevant service.

Rarecation Travel does not control, process, collect, calculate, approve, or administer charges made directly by a third-party supplier during the trip. Accordingly, Rarecation Travel shall not be responsible or liable for any pricing error, incorrect charge, duplicate charge, unauthorised charge, billing dispute, refund delay, or service issue arising from such supplier charge.

Rarecation Travel may, as a courtesy and without obligation, facilitate communication or provide reasonable booking information to assist the Customer in raising a claim with the relevant supplier. However, Rarecation Travel does not guarantee that the supplier will investigate, correct, reverse, refund, or compensate any disputed charge.

Any correction, refund, credit, compensation, or other remedy relating to a direct supplier charge shall be determined solely by the relevant supplier in accordance with its terms, policies, and applicable law.

5. Pricing and Currency Adjustments

5.1 Quoted Prices and Benchmark Rate

All prices quoted by Rarecation Travel are based on the costs, fares, taxes, charges, supplier availability, and currency exchange rates prevailing at the time of quotation or booking confirmation.

For the purposes of these Terms, the “Benchmark Rate” means the applicable exchange rate used by Rarecation Travel’s relevant supplier, bank, payment provider, or a generally accepted market reference at the time the quotation is issued or the booking is confirmed, as applicable.

Unless expressly stated otherwise in writing, quoted prices are subject to change until the booking is confirmed and the required payment has been received.

5.2 Price Components

The total booking price may include one or more of the following components:

a) cruise fare, cabin fare, and cruise-related charges;

b) airline fare, airport taxes, and carrier-imposed charges;

c) hotel, accommodation, transfer, tour, excursion, or other supplier charges;

d) government taxes, port charges, terminal charges, tourism taxes, and regulatory fees;

e) fuel surcharges, security charges, service charges, and currency-conversion costs; and

f) Rarecation Travel’s applicable administrative, handling, booking, consultation, or processing fees.

Unless specifically stated in the quotation or invoice, prices may exclude personal expenses, insurance, visa costs, gratuities, meals, baggage fees, optional excursions, incidental hotel charges, and any other amount not expressly included.

5.3 Circumstances Permitting Price Adjustments

Rarecation Travel reserves the right to revise the booking price, impose a surcharge, or require an additional payment where there is an increase in cost after quotation or booking confirmation arising from circumstances beyond Rarecation Travel’s reasonable control.

Such circumstances include, without limitation:

a) an increase in cruise fares, cabin fares, or cruise-line charges;

b) an increase in airline fares, airport taxes, carrier charges, or fuel surcharges;

c) a change in government taxes, port charges, terminal charges, tourism taxes, visa charges, or other mandatory fees;

d) an increase in hotel, transport, tour, excursion, or other supplier charges;

e) an error in a quoted price, tax, fare, exchange rate, or booking information; and/or

f) a fluctuation in the exchange rate between Malaysian Ringgit (“MYR”) and the relevant foreign currency.

5.4 Currency Fluctuation Surcharge

Where the MYR depreciates against the relevant foreign currency by more than ten percent (10%) from the Benchmark Rate, Rarecation Travel reserves the right to impose a surcharge to reflect the resulting increase in the cost of the travel arrangements.

Rarecation Travel may also impose a surcharge where a supplier applies a different exchange rate, currency-conversion charge, settlement rate, or currency-related adjustment that increases Rarecation Travel’s actual cost, even if the fluctuation is less than ten percent (10%).

The surcharge shall be calculated reasonably by reference to the increased cost attributable to the relevant booking, including any additional supplier charges, bank charges, payment-processing charges, and currency-conversion costs.

5.5 Notice of Price Adjustment

Where reasonably practicable, Rarecation Travel will notify the Customer in writing of any price adjustment before the final payment deadline. The notice may state:

a) the reason for the adjustment;

b) the amount of the additional payment or surcharge;

c) the revised total booking price;

d) the payment deadline; and

e) the available options, if any.

The Customer must pay any required surcharge by the stated deadline. Failure to do so may result in the booking being cancelled, released, or treated as cancelled by the Customer. All payments already made shall remain subject to the non-refundable payment policy under Clause 3.

5.6 Customer Options Following a Price Adjustment

Following notification of a price adjustment, the Customer may:

a) proceed with the booking by paying the applicable surcharge within the specified deadline; or

b) request cancellation of the booking, subject to the applicable Supplier Terms, cancellation charges, and Rarecation Travel’s non-refundable payment policy.

A cancellation by the Customer due to a price adjustment does not automatically entitle the Customer to a refund. Any refund, if available, shall be strictly subject to Clause 3, the relevant Supplier Terms, and applicable law.

5.7 Exchange-Rate Determination

For the avoidance of doubt, exchange-rate fluctuations and applicable currency adjustments may be determined by reference to:

a) exchange rates applied by the relevant supplier;

b) rates applied by Rarecation Travel’s bank, payment provider, or foreign-exchange provider;

c) published interbank, market, or other generally accepted currency references; or

d) the actual cost incurred or payable by Rarecation Travel in the relevant foreign currency.

Rarecation Travel’s determination of the applicable rate and resulting surcharge shall be made reasonably and in good faith.

5.8 No Liability for Currency Movements

Rarecation Travel shall not be liable for any loss, increased cost, price adjustment, currency-conversion difference, or other consequence arising from exchange-rate movements, foreign-currency settlement requirements, supplier pricing changes, or other matters beyond Rarecation Travel’s reasonable control.

Nothing in this clause limits any right or remedy that cannot lawfully be excluded under applicable law.

5.9 Twin-Sharing Bookings and Single-Occupancy Supplement

Where a Customer books a cruise, hotel, tour, or travel package on a twin-sharing basis, the quoted price is based on two eligible travellers sharing the same cabin, room, or accommodation arrangement.

If the Customer is travelling alone, or if the intended travelling companion cancels, fails to pay, fails to travel, is denied boarding, is unable to share the accommodation, or otherwise does not occupy the shared cabin or room, the Customer may be required to occupy the accommodation on a single-occupancy basis.

In such circumstances, Rarecation Travel reserves the right to impose the applicable single-occupancy supplement, fare difference, cabin-rate difference, supplier charge, tax difference, or any other additional amount charged by the relevant supplier. The Customer shall pay the additional amount by the deadline specified by Rarecation Travel.

If the Customer does not pay the required additional amount, Rarecation Travel may, subject to availability and supplier approval, offer an alternative arrangement or cancel the booking. Any cancellation in these circumstances shall be treated as a cancellation by the Customer, and all payments made shall remain subject to Clause 3, Clause 7, and the relevant Supplier Terms.

Rarecation Travel does not guarantee that a suitable travel companion, shared cabin arrangement, or replacement traveller will be available. Rarecation Travel shall not be liable for any additional cost arising from single occupancy or the unavailability of a twin-sharing arrangement.

6. Pricing Errors and Corrections

6.1 Right to Correct Errors

Rarecation Travel makes reasonable efforts to ensure that all prices, fares, taxes, charges, promotions, quotations, invoices, website content, advertisements, and booking confirmations are accurate. However, errors may occasionally occur.

Rarecation Travel reserves the right to correct any typographical, clerical, system, technical, data-entry, calculation, currency-conversion, fare-loading, tax, surcharge, promotional, supplier-content, or pricing error at any time, including after a quotation has been issued, payment has been received, or a booking confirmation has been sent.

6.2 Errors Covered by This Clause

This clause applies where a price or booking detail is incorrect due to, including but not limited to:

a) an incorrect cruise fare, airline fare, hotel rate, package price, cabin category, or travel date;

b) an omitted or incorrectly calculated tax, port charge, fuel surcharge, service charge, supplier fee, or currency-conversion amount;

c) a pricing or availability error caused by a supplier, reservation system, website, payment platform, or other third-party;

d) a typographical or publishing error in an advertisement, social-media post, website, promotional material, quotation, invoice, or booking confirmation;

e) an incorrect exchange rate, currency, discount, promotion, or calculation; or

f) a price that is clearly or materially inconsistent with the actual supplier cost, prevailing market price, or intended offer.

A quotation, invoice, booking confirmation, or payment receipt containing such an error shall not constitute an obligation for Rarecation Travel to provide the travel arrangements at the erroneous price.

6.3 Notice of Correction

Where Rarecation Travel identifies a pricing or booking error, it will notify the Customer as soon as reasonably practicable. Rarecation Travel may provide the Customer with a revised quotation, invoice, booking confirmation, or payment request stating the corrected price and any corresponding changes to the travel arrangements.

The Customer must respond by the deadline specified by Rarecation Travel. If the Customer does not respond or make the required additional payment by that deadline, Rarecation may cancel, release, or treat the booking as cancelled.

6.4 Customer Options

Following notification of a genuine pricing error, the Customer may:

a) proceed with the booking by accepting the corrected price and paying any additional amount required by the stated deadline; or

b) cancel the affected booking and receive a refund of payments made to Rarecation Travel for that affected booking, subject to Clause 6.5.

If the Customer elects to proceed, the corrected price, fare conditions, Supplier Terms, and these Terms and Conditions shall apply to the booking.

6.5 Refund Following Cancellation Due to a Pricing Error

Where the Customer cancels solely because of a pricing error identified by Rarecation Travel, the Agency will refund the amount received by it for the affected booking, less any amount that has already been validly paid to a supplier and is not recoverable by Rarecation Travel, unless otherwise required by applicable law.

Rarecation Travel will use reasonable efforts to seek recovery from the relevant supplier where appropriate. However, Rarecation Travel is not responsible for a supplier’s refusal, delay, or failure to refund any amount.

This clause applies only to cancellation arising directly from Rarecation Travel’s correction of a genuine pricing error. It does not apply to customer-initiated cancellations for other reasons, which remain subject to Clause 3 and the applicable Supplier Terms.

6.6 No Liability for Good-Faith Error

Rarecation Travel shall not be liable for any loss, disappointment, inconvenience, price difference, lost opportunity, travel disruption, or consequential loss arising from a good-faith pricing or booking error, or from the correction, cancellation, or amendment of a booking resulting from such error.

Nothing in this clause excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

7. Changes or Cancellation by Customer

7.1 Written Request Requirement

Any request by the Customer to amend, transfer, substitute, postpone, reduce, cancel, or otherwise change a booking must be submitted to Rarecation Travel in writing by the booking holder or an authorised person.

A request shall not be effective unless and until Rarecation Travel confirms the requested change or cancellation in writing. The submission of a request does not guarantee that it will be accepted by Rarecation Travel or the relevant supplier.

Rarecation Travel may require reasonable identity verification, booking details, written authority, and supporting documents before acting on any request.

7.2 Changes and Amendments

All amendments are subject to:

a) availability;

b) approval by the relevant supplier;

c) the applicable Supplier Terms;

d) the applicable fare rules and booking conditions; and

e) payment of all amendment-related charges.

Amendments may include changes to travel dates, cruise itinerary, cabin category, flight, hotel, passenger details, passenger names, destination, transfer, tour, or any other travel arrangement.

Rarecation Travel has no obligation to obtain, process, or secure an amendment requested by the Customer. Where an amendment is not approved or available, the original booking shall remain in force and the Customer shall remain liable for the full booking price.

7.3 Amendment Charges

The Customer shall be responsible for all costs arising from any amendment, including, without limitation:

a) supplier amendment, reissue, rebooking, or administration fees;

b) fare differences, rate increases, tax differences, port charges, and surcharges;

c) additional supplier deposits or payment requirements;

d) Rarecation Travel’s administrative, handling, consultation, processing, or service fees; and

e) payment gateway, bank, foreign-exchange, or transaction charges.

Any amendment may result in the loss of an existing promotional fare, cabin, seat, room, itinerary, or other booking benefit. The Customer must pay all applicable charges before Rarecation Travel processes or confirms an amendment.

7.4 Customer Cancellations

A cancellation is effective only when Rarecation Travel receives the written cancellation request and confirms the cancellation in writing. The date on which Rarecation Travel receives the written request shall be treated as the cancellation date for the purpose of determining any supplier cancellation charges.

The Customer may cancel a booking at any time; however, all payments remain subject to Clause 3, the applicable Supplier Terms, and this Clause 7. A cancellation request does not automatically entitle the Customer to a refund, credit, postponement, transfer, or substitute travel arrangement.

7.5 Cancellation Charges and Non-Refundable Amounts

Cancellation charges, forfeitures, and any available supplier refund or credit shall be determined by the relevant Supplier Terms in force at the time of cancellation.

Except where a refund is required under applicable law, the following amounts are strictly non-refundable once any payment has been made or the booking has been confirmed, as applicable:

a) Rarecation Travel service, consultation, booking, administrative, handling, processing, amendment, and payment-related fees;

b) deposits, advance payments, and amounts paid or committed to suppliers;

c) promotional fares, discounted fares, early-bird fares, flash-sale fares, group fares, and other special offers;

d) non-refundable or restricted cruise fares, airline tickets, hotel reservations, transfers, tours, excursions, and other supplier services;

e) taxes, port charges, surcharges, currency-conversion costs, bank fees, payment-gateway fees, and transaction fees, where non-recoverable; and

f) any other amount that Rarecation Travel or the relevant supplier is entitled to retain under these Terms or the Supplier Terms.

Where supplier cancellation charges, penalties, or other non-recoverable costs exceed the amount already paid by the Customer, Rarecation Travel reserves the right to recover the balance from the Customer.

7.6 Partial Cancellation or Reduction in Travellers

If one or more travellers cancel, fail to travel, or are removed from a booking, the remaining travellers may be subject to revised fares, cabin rates, room rates, single-occupancy supplements, supplier charges, or the loss of group, promotional, or package benefits.

The Customer is responsible for any resulting increase in the booking price. A partial cancellation does not entitle the remaining travellers to retain the original price or booking conditions.

7.7 Passenger Name Changes and Transfers

Passenger names, bookings, tickets, cabins, airline seats, and other travel arrangements may be non-transferable and may not be changed after confirmation.

Any permitted name correction or passenger substitution is subject to supplier approval, applicable deadlines, documentation requirements, fare rules, and payment of all associated charges. Rarecation Travel shall not be responsible if a supplier refuses a name change, passenger substitution, or transfer.

7.8 No Show and Failure to Travel

If the Customer or any traveller fails to check in, board, embark, arrive at the required location, provide required documents, comply with supplier requirements, or otherwise fails to use a booked travel service at the required time, this shall be treated as a “No Show”.

A No Show shall be treated as a cancellation by the Customer with full forfeiture of all payments made, unless otherwise required by applicable law. Rarecation Travel and the relevant supplier shall have no obligation to provide a refund, credit, rebooking, substitute service, or compensation.

7.9 Unused Services After Travel Commences

No refund, credit, compensation, or reduction in price shall be provided for any unused, partially used, missed, refused, or voluntarily discontinued service after travel has commenced.

This includes unused nights of accommodation, missed flights, missed embarkation, unused cruise nights, unused transfers, excursions, meals, tours, activities, or any other component of the travel arrangements.

7.10 Customer Responsibility for Consequences of Changes or Cancellation

The Customer accepts full responsibility for all consequences arising from a requested amendment, cancellation, delay, non-travel, failure to provide documents, failure to comply with Supplier Terms, or No Show.

Rarecation Travel shall not be liable for any loss of payment, fare increase, cancellation charge, supplier penalty, travel disruption, denied boarding, missed connection, lost reservation, or other loss arising from the Customer’s amendment, cancellation, delay, or failure to travel.

Nothing in this clause excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable law.

8. Changes or Cancellation by Suppliers

8.1 Supplier Operational Control

All cruise, flight, hotel, transfer, tour, excursion, and other travel services are operated and controlled by independent third-party suppliers. Rarecation Travel does not own, operate, manage, or control any cruise vessel, airline, hotel, transport service, port, terminal, tour, or other supplier service.

Accordingly, suppliers retain the right to make operational, commercial, safety, security, regulatory, weather-related, medical, technical, or other changes to their services at any time.

8.2 Supplier Changes

A supplier may, with or without prior notice, modify, substitute, postpone, shorten, suspend, or cancel any part of the travel arrangements. Such changes may include, without limitation:

a) changes to cruise itineraries, ports of call, embarkation or disembarkation ports, arrival or departure times, or time spent at a port;

b) port substitutions, port omissions, berth changes, terminal changes, tender operations, or changes caused by port congestion, weather, sea conditions, local restrictions, or government directions;

c) sailing schedule adjustments, delayed embarkation, early departure, shortened voyage, extended voyage, or cancellation of a sailing;

d) flight schedule changes, route changes, aircraft changes, carrier changes, delays, missed connections, diversions, denied boarding, or cancellation of flights;

e) replacement, substitution, or withdrawal of a vessel, aircraft, hotel, transport vehicle, tour, excursion, cabin, room, or other supplier service;

f) cancellation, suspension, or alteration of tours, excursions, transfers, accommodation, meals, entertainment, onboard facilities, or other travel components; and

g) changes required by safety, security, health, immigration, customs, operational, technical, regulatory, weather, force majeure, labour, or other circumstances.

The Customer acknowledges that an itinerary, schedule, port, airline, vessel, aircraft, hotel, tour, or other travel arrangement may change and is not guaranteed unless expressly confirmed otherwise by the relevant supplier.

8.3 Notice of Supplier Changes

Where Rarecation Travel receives notice of a material supplier change or cancellation, Rarecation Travel will use reasonable efforts to notify the Customer using the contact details provided in the booking.

The Customer is responsible for ensuring that all contact details are accurate, current, and accessible before and during travel. Rarecation Travel shall not be liable for any failure to notify the Customer where the Customer’s contact details are inaccurate, unavailable, or not monitored.

Rarecation Travel is not responsible for any supplier change or cancellation that occurs without prior notice to Rarecation Travel or the Customer.

8.4 Rarecation Travel’s Role

Rarecation Travel shall not be responsible or liable for any operational decision, act, omission, delay, cancellation, substitution, itinerary change, port omission, schedule change, reduction in services, or service failure made by a supplier.

Rarecation Travel does not guarantee the operation, timing, route, itinerary, availability, quality, safety, suitability, or outcome of any supplier service. Rarecation Travel shall not be liable for any resulting loss, expense, inconvenience, disappointment, missed connection, accommodation cost, transport cost, visa issue, loss of holiday time, or other consequential loss.

8.5 Supplier Refunds, Credits, Compensation, and Alternatives

Any refund, credit, compensation, rebooking, alternative travel arrangement, accommodation, meal, transfer, or other remedy arising from a supplier change or cancellation shall be determined solely by the relevant supplier in accordance with its applicable terms and policies.

Rarecation Travel may, as a courtesy and without obligation, assist the Customer to communicate with the supplier or submit a request for a refund, credit, rebooking, or compensation. However, Rarecation Travel does not guarantee that any request will be approved, processed, or paid by the supplier.

Any refund, credit, compensation, or alternative arrangement offered by a supplier may be subject to conditions, restrictions, deadlines, deductions, fare differences, additional payments, or non-transferability. The Customer remains responsible for complying with those requirements.

8.6 Additional Costs

Unless expressly agreed otherwise in writing by the relevant supplier, the Customer is responsible for all personal, incidental, and consequential costs arising from a supplier change or cancellation.

This may include, without limitation, additional accommodation, meals, transfers, transport, flight changes, visa costs, insurance costs, communication costs, baggage costs, or other expenses incurred by the Customer.

Rarecation Travel shall not be required to advance, reimburse, absorb, or compensate any such cost.

8.7 Non-Refundable Rarecation Travel Fees

Any supplier refund, credit, or compensation does not automatically include Rarecation Travel’s administrative, booking, consultation, handling, processing, payment-related, or service fees. Such fees remain strictly non-refundable in accordance with Clause 3.

8.8 No Right to Cancel Solely Due to Supplier Changes

A supplier change, including an itinerary change, port substitution, flight-time change, vessel or aircraft replacement, or a change to an onboard or travel service, does not automatically entitle the Customer to cancel the booking or receive a refund from Rarecation.

Any cancellation request by the Customer following a supplier change shall be treated as a customer cancellation and shall remain subject to Clause 3, Clause 7, the relevant Supplier Terms, and applicable law.

8.9 Preservation of Non-Excludable Rights

Nothing in this clause excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable law.

9. Flight Scheduling and Missed Embarkation

9.1 Flight Arrangements for Full Packages

Where flights are arranged by Rarecation Travel as part of a full travel package, Rarecation Travel will use reasonable efforts to propose flight schedules that allow a reasonable period for the Customer to travel to the cruise embarkation port before the scheduled embarkation time.

However, flight schedules, connection times, airport procedures, immigration clearance, baggage collection, ground transfers, traffic conditions, and embarkation cut-off times are outside Rarecation Travel’s control. The proposed flight arrangements do not guarantee that the Customer will arrive at the port in time to board the cruise vessel.

The Customer remains responsible for ensuring that they arrive at the airport, complete check-in and immigration procedures, board the flight, and arrive at the embarkation port within the times required by the airline, cruise line, port authority, and other relevant suppliers.

9.2 Acceptance of Flight Arrangements and Seat Selection

By confirming the booking, the Customer accepts the proposed flight arrangements, including the airline, flight schedule, route, connection, airport, travel date, fare conditions, baggage allowance, and any transit requirements.

Any airline seat selection, including standard seats, preferred seats, extra-legroom seats, exit-row seats, or other paid seating options, is subject to the relevant airline’s availability, rules, operational requirements, and final approval.

Where the Customer wishes to request or purchase a specific airline seat, the request must be made during the initial booking process and before the booking is confirmed. Requests made after booking confirmation may not be accepted and shall remain subject to airline availability and approval.

Any seat-selection charge must be paid in full when requested by Rarecation Travel. All seat-selection charges are strictly non-refundable, except where a refund is required by applicable law or expressly approved by the airline.

A purchased or confirmed seat does not guarantee that the Customer will occupy that specific seat throughout the journey. The airline may change, reassign, remove, or cancel any seat allocation at any time for operational, aircraft, safety, security, medical, regulatory, schedule-change, or other reasons. Rarecation Travel shall not be responsible for any seat change, reassignment, downgrade, or cancellation made by the airline.

9.3 No Customer-Initiated Flight Changes After Booking

Once a flight booking has been confirmed, the Customer may not request a change to the flight date, flight time, route, airline, airport, connection, or passenger name, unless Rarecation Travel and the relevant airline expressly approve the request in writing.

Any approved change remains subject to the airline’s fare rules, availability, Supplier Terms, applicable deadlines, fare differences, taxes, surcharges, airline penalties, reissue fees, and Rarecation Travel administrative charges. The Customer must pay all applicable additional amounts in full before Rarecation Travel will process an approved change.

Rarecation Travel and the airline are under no obligation to approve any requested flight change. If a requested change is not approved, the original flight booking shall remain in force. If the Customer elects not to use the original flight, it shall be treated as a cancellation or No Show under Clause 7.

9.4 Airline Schedule and Operational Changes

Airlines may change flight schedules, routes, aircraft, airports, connections, seating, baggage allowances, or other flight arrangements at any time. Airlines may also delay, cancel, divert, reschedule, or replace a flight for operational, weather, safety, security, technical, regulatory, crew, air-traffic, or other reasons.

Rarecation Travel does not control such airline decisions and does not guarantee the timing, operation, connection, or arrival of any flight. Any refund, credit, rebooking, compensation, accommodation, meal, or alternative arrangement arising from an airline change or disruption shall be subject solely to the airline’s applicable policies and Supplier Terms.

9.5 Missed Embarkation

Rarecation Travel shall not be responsible or liable for missed cruise departures, denied embarkation, missed boarding, missed connections, or any related loss arising from:

a) flight delays, cancellations, diversions, rescheduling, or operational changes;

b) missed flight connections or insufficient connection time;

c) late check-in or late arrival at the airport, port, terminal, boarding gate, vessel, or designated meeting point;

d) immigration, customs, security, health-screening, visa, passport, or document-related delays or refusals;

e) baggage delays, lost baggage, or baggage-clearance delays;

f) traffic congestion, ground-transport disruption, road closures, weather conditions, or other transport delays;

g) the Customer’s failure to comply with airline, cruise-line, airport, port, government, or other supplier requirements;

h) any act, omission, delay, or service failure of an airline, airport, transport provider, port authority, cruise line, or other third-party supplier;

i) loss, theft, damage, expiry, invalidity, or unavailability of the Customer’s passport, visa, identification document, boarding pass, cruise document, vaccination record, or any other required travel document;

j) the Customer leaving the vessel, port, terminal, airport, excursion, transit area, or designated meeting point and failing to return by the time specified by the cruise line, tour operator, port authority, or other supplier;

k) the Customer returning late from a shore excursion, independent activity, shopping, dining, sightseeing, personal appointment, or any activity not organised or controlled by the cruise line or Rarecation Travel; or

l) the Customer’s failure to monitor, understand, or comply with the applicable all-aboard time, boarding time, check-in time, meeting time, departure time, or local-time requirement.

The Customer acknowledges that cruise vessels operate according to fixed schedules and may depart without the Customer. The cruise line is not required to delay departure or permit boarding after its stated embarkation cut-off time.

The Customer is solely responsible for safeguarding all travel documents and for returning to the vessel, terminal, airport, or designated meeting point before the applicable deadline. If the Customer misses embarkation for any reason, all resulting costs—including replacement documents, transport, accommodation, rebooking, meals, visa costs, and onward travel—shall be borne solely by the Customer.

9.6 Assistance and Alternative Arrangements

Where reasonably possible, Rarecation Travel may, at its sole discretion and as a courtesy, assist the Customer in exploring alternative flight, transfer, hotel, or onward-travel arrangements after a missed embarkation or flight disruption.

Such assistance does not create an obligation for Rarecation Travel to secure, pay for, advance, guarantee, or arrange any alternative service. All additional costs shall be borne solely by the Customer, including airfare, fare differences, accommodation, transfers, meals, visa costs, insurance costs, port transportation, rebooking fees, supplier charges, and Rarecation Travel’s administrative fees.

Any alternative arrangement remains subject to availability, supplier approval, Supplier Terms, and full payment by the Customer before confirmation.

9.7 Customer Travel Protection

The Customer is strongly advised to obtain suitable travel insurance, including coverage for flight disruptions, missed connections, missed cruise embarkation, baggage delays, loss of travel documents, medical emergencies, cancellation, and curtailment.

The Customer remains responsible for understanding the scope, exclusions, and claims procedure of any travel-insurance policy purchased.

9.8 Preservation of Non-Excludable Rights

Nothing in this clause excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable law.

10. Passports, Visas, Travel Documentation, and Information Accuracy

10.1 Customer Responsibility for Travel Documents

The Customer is solely responsible for checking, obtaining, maintaining, carrying, and presenting all documents required for travel.

This includes, without limitation:

a) valid passports;

b) visas and transit visas;

c) entry permits and residency documents;

d) identification documents;

e) boarding passes, cruise documents, tickets, vouchers, and booking confirmations;

f) vaccination certificates, health declarations, medical certificates, and travel-insurance documents; and

g) any other document required by an airline, cruise line, hotel, port authority, immigration authority, customs authority, or other relevant supplier or government authority.

This responsibility applies to all destinations, ports of call, transit countries, stopovers, embarkation ports, disembarkation ports, and countries that may be visited or transited during the travel arrangements.

10.2 Visa, Transit, and Entry Requirements

The Customer must independently verify whether a visa, transit visa, entry permit, vaccination certificate, health declaration, return or onward ticket, proof of accommodation, proof of funds, or any other entry document is required.

Requirements may vary based on the Customer’s nationality, passport type, country of residence, travel history, destination, transit route, length of stay, and purpose of travel. Such requirements may change without prior notice.

Any information provided by Rarecation Travel regarding visas, passports, immigration, health, or entry requirements is provided for general guidance only. The Customer must independently confirm the latest requirements with the relevant embassy, consulate, immigration authority, airline, cruise line, or other competent authority before travel.

Rarecation Travel does not guarantee the accuracy, completeness, or continued validity of any travel-document or entry-requirement information provided to the Customer.

10.3 Passport Validity

The Customer must ensure that every traveller holds a passport that is valid, undamaged, and acceptable for travel throughout the entire journey.

The Customer is responsible for checking that each passport has sufficient remaining validity and blank pages, where required. Many destinations, transit countries, cruise lines, and airlines require a passport to remain valid for a specified period after the date of travel.

10.4 Customer Responsibility for Booking Information

The Customer is solely responsible for ensuring that all information provided to Rarecation Travel during enquiry, quotation, booking, payment, and travel-document issuance is complete, accurate, current, and consistent with the relevant traveller’s official documents.

This includes, without limitation:

a) passenger names;

b) passport numbers, nationality, date of birth, passport issue date, and passport expiry date;

c) travel dates, destination, cabin or room occupancy, flight, and other booking details;

d) telephone numbers, email addresses, emergency-contact details, and billing information;

e) visa, immigration, health, medical, and special-assistance information; and

f) any other information required by Rarecation Travel or the relevant supplier.

The Customer must promptly notify Rarecation Travel in writing of any error or change in this information. A request to correct or amend information remains subject to supplier approval, applicable deadlines, fare rules, and fees.

10.5 Passenger Names Must Match Passport

For airline, cruise, and other travel bookings, each passenger’s name must exactly match the name shown in that passenger’s passport or other required travel document.

The Customer must carefully check all booking confirmations, tickets, cruise documents, and invoices immediately upon receipt. Any error must be reported to Rarecation Travel in writing without delay.

Name corrections, name changes, and passenger substitutions may be restricted, unavailable, or subject to supplier approval, fare differences, reissue fees, cancellation charges, and Rarecation Travel administrative fees. In some cases, a booking may need to be cancelled and rebooked at the Customer’s cost.

10.6 Consequences of Incorrect Information or Documents

Rarecation Travel shall not be responsible or liable for any loss, cost, fine, penalty, delay, denied boarding, refused embarkation, visa refusal, refused entry, cancellation, missed flight, missed cruise departure, loss of fare, rebooking cost, or other consequence arising from:

a) inaccurate, incomplete, late, expired, damaged, invalid, or inconsistent information or documents provided by the Customer;

b) a passenger name that does not match the passport or required travel document;

c) the Customer’s failure to obtain, carry, present, or comply with required documents or entry requirements; or

d) any refusal, decision, delay, or requirement imposed by an airline, cruise line, immigration authority, port authority, embassy, consulate, or other third-party supplier or authority.

If a Customer is unable to travel due to any of the above circumstances, the booking shall be treated as a cancellation or No Show by the Customer. All payments shall remain subject to Clause 3, Clause 7, the applicable Supplier Terms, and applicable law.

10.7 Costs and Changes

All visa fees, passport-renewal fees, document-replacement fees, courier charges, vaccination costs, health-test costs, supplier amendment fees, reissue fees, fines, penalties, and other document-related expenses shall be borne solely by the Customer.

The Customer remains responsible for complying with any new or amended passport, visa, health, immigration, customs, or entry requirement imposed after booking confirmation. Such changes do not automatically entitle the Customer to cancel the booking or receive a refund.

11. Shore Excursions, Ground Tours, and Independent Activities

11.1 Scope of This Clause

This clause applies to all shore excursions, ground tours, transfers, sightseeing activities, port activities, transportation, meals, attractions, shopping stops, optional activities, and other land-based arrangements undertaken during or in connection with the Customer’s cruise or travel itinerary (“Shore Excursions”).

Shore Excursions may be arranged by the cruise line, Rarecation Travel, a local operator, a tour operator, transport provider, attraction operator, or another third-party supplier.

11.2 Customer’s Personal Responsibility

The Customer participates in every Shore Excursion at their own risk and remains solely responsible for their own safety, health, conduct, belongings, travel documents, personal decisions, and compliance with all instructions and requirements.

The Customer must:

a) follow the confirmed Shore Excursion itinerary, meeting point, departure time, return time, and instructions given by the guide, operator, cruise line, port authority, or other supplier;

b) return to the vessel, port, terminal, or designated meeting point before the applicable all-aboard or departure time;

c) monitor local time and any time-zone difference, particularly where the vessel’s time differs from local port time;

d) comply with all safety instructions, local laws, rules, dress codes, age limits, health requirements, and activity restrictions;

e) assess their own fitness, medical condition, mobility, swimming ability, and suitability before participating in any activity;

f) safeguard their own passport, travel documents, cash, valuables, baggage, and personal belongings; and

g) arrange and maintain a working mobile telephone and suitable internet access, roaming service, local SIM card, or other reliable means of communication during the Shore Excursion, where reasonably available.

11.3 Communications

The Customer is responsible for ensuring that Rarecation Travel, the cruise line, and/or the relevant Shore Excursion operator has accurate and current contact details for the Customer.

The Customer must remain reasonably contactable during the Shore Excursion, particularly where the Shore Excursion is independently arranged or where any change, disruption, emergency, or return-to-vessel arrangement arises.

Rarecation Travel shall not be responsible for any loss, delay, missed embarkation, or other consequence where the Customer cannot be contacted due to lack of mobile coverage, unavailable internet access, a switched-off device, insufficient battery, an incorrect contact number, or any other communication failure.

11.4 Independent Activities and Late Return

Where the Customer undertakes an independent Shore Excursion or activity that is not organised, sold, or controlled by the cruise line, the Customer does so entirely at their own risk.

The Customer is solely responsible for allowing sufficient time to return to the vessel before the all-aboard time. The cruise vessel is not required to wait for a Customer who returns late from an independently arranged Shore Excursion, shopping, dining, sightseeing, personal appointment, private transport, or any other activity.

If the Customer misses embarkation or is left behind at a port for any reason, all resulting costs shall be borne solely by the Customer. These may include accommodation, meals, transport, replacement travel documents, flights, transfers, visa costs, rebooking fees, port charges, and onward travel to the next port or home destination.

11.5 Liability for Third-Party Shore Excursion Providers

Rarecation Travel acts solely as an intermediary where it assists in arranging a Shore Excursion provided by a third-party supplier. Rarecation Travel does not own, operate, control, supervise, or manage the Shore Excursion, vehicles, equipment, guides, premises, activities, or personnel of any third-party supplier.

Except where liability cannot lawfully be excluded, Rarecation Travel shall not be responsible or liable for any injury, illness, death, accident, delay, cancellation, service failure, property loss, theft, damage, dissatisfaction, missed embarkation, or other loss arising from:

a) the acts, omissions, negligence, conduct, decisions, or service failures of a third-party Shore Excursion provider;

b) the Customer’s participation in a Shore Excursion or independent activity;

c) unsafe conditions, weather, sea conditions, road conditions, wildlife, natural hazards, local conditions, or events beyond Rarecation Travel’s reasonable control;

d) the Customer’s failure to follow instructions, meet return times, comply with local laws, or take reasonable care for their own safety and belongings; or

e) any injury, loss, or damage suffered by the Customer or caused by the Customer to another person or property.

11.6 Health, Fitness, Safety, and Insurance

The Customer is solely responsible for assessing whether they are medically, physically, mentally, and otherwise fit to participate in each Shore Excursion, activity, tour, transfer, sport, water activity, adventure activity, or other service undertaken during the trip.

The Customer acknowledges that each activity may have its own fitness level, age limit, medical condition, mobility, swimming ability, pregnancy, weight, clothing, equipment, safety, or other participation requirement imposed by the relevant supplier. The Customer must review, understand, and comply with all such requirements, instructions, warnings, waivers, and safety procedures before and during participation.

The Customer must disclose any relevant medical condition, mobility limitation, pregnancy, disability, allergy, dietary requirement, medication requirement, or special-assistance need directly to the relevant operator before participation. Rarecation Travel does not assess the Customer’s fitness or suitability for any activity and does not guarantee that any activity is suitable for the Customer.

If the Customer chooses to participate in an activity despite not meeting, or being unable to meet, the relevant fitness, health, safety, or participation requirements, the Customer does so entirely at their own risk. Except where liability cannot lawfully be excluded, Rarecation Travel shall not be responsible or liable for any injury, illness, accident, loss, damage, delay, inability to participate, denied participation, or other consequence arising from the Customer’s lack of fitness, medical condition, failure to disclose relevant information, or failure to comply with supplier requirements.

The Customer is solely responsible for obtaining and maintaining adequate travel and medical insurance for the entire trip, including insurance appropriate for every activity in which the Customer chooses to participate. The Customer should ensure that the insurance specifically covers, where applicable, Shore Excursions, water sports, adventure activities, personal injury, emergency medical treatment, medical evacuation, personal liability, loss of belongings, missed embarkation, cancellation, and travel disruption.

Rarecation Travel does not provide insurance coverage unless expressly confirmed in writing. The Customer is responsible for reviewing the insurance policy, ensuring that the intended activities are covered, and complying with all policy conditions and claim procedures.

11.7 No Refund for Unused, Missed, Disrupted, or Delayed Shore Excursions

No refund, credit, compensation, or replacement activity will be provided by Rarecation Travel for a Shore Excursion that the Customer misses, cancels, leaves early, is unable to join, or is prevented from joining due to the Customer’s late arrival, illness, documents, conduct, failure to meet participation requirements, or any other circumstance attributable to the Customer.

Rarecation Travel shall also not be responsible for, and shall not provide any refund, credit, compensation, or replacement activity in respect of, a Shore Excursion that is delayed, shortened, changed, disrupted, cancelled, or otherwise affected by the acts, omissions, delays, operational decisions, weather decisions, service failures, or other circumstances involving the relevant operator, transport provider, local supplier, port authority, or other third-party supplier.

Where a Shore Excursion is delayed, changed, cancelled, or materially affected by a third-party supplier, any refund, credit, compensation, rebooking, replacement activity, or other remedy shall be determined solely by that supplier in accordance with its applicable terms and policies.

Rarecation Travel may, as a courtesy and without obligation, assist the Customer in communicating with the relevant supplier or submitting a request for a remedy. However, Rarecation Travel does not guarantee that any request will be approved, processed, or paid. Any supplier-approved refund, credit, or compensation shall remain subject to the supplier’s terms, conditions, deductions, and applicable law.

11.8 Tipping and Gratuities

Unless expressly stated in the booking confirmation or Supplier Terms as a mandatory charge, tipping and gratuities are entirely voluntary and are at the Customer’s sole discretion.

The Customer may decide whether, when, and how much to tip any tour guide, driver, local operator, cruise staff member, or other service provider. Rarecation Travel does not require, collect, control, or guarantee any voluntary tip or gratuity.

Where a cruise line, hotel, tour operator, restaurant, or other supplier imposes mandatory gratuities, service charges, or tipping-related charges, those amounts shall be governed by the relevant Supplier Terms and remain payable by the Customer where applicable.

11.9 Preservation of Non-Excludable Rights

Nothing in this clause excludes or limits any liability arising directly from Rarecation Travel’s own negligence, error, or wilful misconduct, or any right or remedy that cannot lawfully be excluded or limited under applicable law.

12. Prohibited Items and Passenger Conduct

12.1 Compliance with Rules and Laws

The Customer and all travellers must comply at all times with:

a) these Terms and Conditions;

b) the applicable Supplier Terms;

c) the rules, instructions, safety requirements, and codes of conduct of cruise lines, airlines, hotels, tour operators, transport providers, ports, terminals, and other suppliers;

d) all applicable laws, regulations, immigration requirements, customs rules, health requirements, and security procedures; and

e) all lawful directions given by the captain, crew, airline staff, port authority, tour guide, security personnel, immigration officer, police officer, or other authorised person.

The Customer is responsible for ensuring that all travellers included in the booking understand and comply with these requirements.

12.2 Prohibited, Restricted, and Dangerous Items

The Customer must not bring, carry, conceal, transport, purchase, use, or attempt to board with any prohibited, illegal, dangerous, restricted, or hazardous item.

Such items may include, without limitation:

a) weapons, firearms, ammunition, knives, sharp objects, replicas, or weapon-like items;

b) explosives, fireworks, flares, incendiary devices, or explosive materials;

c) illegal drugs, controlled substances, drug paraphernalia, or any prohibited substance;

d) flammable liquids, gas cylinders, compressed gas, corrosive substances, toxic substances, radioactive materials, or other hazardous materials;

e) counterfeit goods, illegal merchandise, undeclared cash or valuables, or items prohibited by customs or local law;

f) drones, laser devices, electrical equipment, batteries, or other items restricted by the relevant supplier or authority; and

g) any other item prohibited or restricted by the cruise line, airline, port authority, hotel, transport provider, local authority, or applicable law.

The Customer is solely responsible for checking the applicable baggage, security, customs, and prohibited-item rules before travel. Rarecation Travel shall not be liable for any confiscation, delay, fine, arrest, refused boarding, removal, cancellation, loss, or other consequence arising from prohibited or restricted items.

12.3 Responsible and Respectful Conduct

The Customer must behave responsibly, respectfully, and lawfully throughout the journey, including during flights, at airports, onboard a cruise vessel, at ports, during Shore Excursions, at hotels, in vehicles, and at all other travel locations.

The Customer must not engage in conduct that is unsafe, disruptive, abusive, threatening, discriminatory, violent, intoxicated, offensive, unlawful, or likely to cause distress, damage, delay, inconvenience, or risk to any person, property, supplier, crew member, staff member, or other traveller.

This includes, without limitation:

a) harassment, bullying, intimidation, discrimination, threats, violence, or abusive language;

b) excessive intoxication, use of illegal substances, smoking or vaping in prohibited areas, or consumption of alcohol contrary to supplier rules;

c) failure to follow safety instructions, emergency procedures, security procedures, or crew directions;

d) damage to cabins, aircraft, hotels, vehicles, terminals, supplier property, or another person’s property;

e) conduct that disrupts the comfort, safety, enjoyment, or rights of other passengers, guests, crew, staff, or local residents; and

f) any conduct that may cause a supplier, authority, or Rarecation Travel to incur a fine, penalty, claim, loss, delay, reputational harm, or operational disruption.

12.4 Refusal of Boarding, Removal, and Denial of Service

The relevant cruise line, airline, port authority, hotel, tour operator, transport provider, or other supplier may refuse boarding, deny check-in, deny entry, remove, disembark, detain, restrict, or terminate services to any Customer or traveller whose conduct, health condition, documents, items, or behaviour is considered unsafe, disruptive, unsuitable, non-compliant, or contrary to Supplier Terms or applicable law.

Such action may be taken without compensation, refund, credit, rebooking, or substitute travel arrangement, except where required by applicable law or expressly approved by the relevant supplier.

Rarecation Travel shall not be responsible for any decision made by a supplier or authority under this clause.

12.5 Rarecation Travel’s Right to Refuse or Terminate Arrangements

Rarecation Travel reserves the right to refuse a booking, decline to process a booking, cancel or terminate its agency services, or refuse further assistance where the Customer’s conduct, communications, payment behaviour, provided information, or actions reasonably appear to be fraudulent, abusive, threatening, unsafe, unlawful, disruptive, or likely to create a safety, legal, financial, or reputational risk.

Where a booking is cancelled, refused, or terminated due to the Customer’s conduct or breach of these Terms, the cancellation shall be treated as a cancellation by the Customer. All payments made shall remain subject to Clause 3, Clause 7, the applicable Supplier Terms, and applicable law.

12.6 Customer Liability for Losses and Costs

The Customer shall be responsible for, and shall reimburse Rarecation Travel and/or the relevant supplier for, any loss, damage, fine, penalty, cleaning charge, repair cost, legal cost, claim, compensation, repatriation cost, accommodation cost, transport cost, or other expense arising from the Customer’s conduct, breach of these Terms, prohibited item, damage to property, or failure to comply with applicable rules or laws.

Where a Customer’s conduct causes disruption to another traveller’s booking or travel arrangements, Rarecation Travel may recover from that Customer any reasonable resulting cost or loss.

12.7 No Liability for Customer Conduct

Rarecation Travel shall not be responsible or liable for any injury, illness, loss, damage, delay, cancellation, denied boarding, removal, arrest, fine, prosecution, detention, confiscation, missed embarkation, or other consequence arising from the Customer’s conduct, prohibited item, non-compliance, or breach of Supplier Terms or applicable law.

Nothing in this clause excludes or limits any liability or right that cannot lawfully be excluded or limited under applicable law.

An emergency contact is usually not contractually liable unless they separately agree to it. This wording makes the Customer responsible, while allowing Rarecation Travel to contact the emergency contact and seek instructions during an emergency.

13. Health, Fitness to Travel, and Medical Emergencies

13.1 Fitness to Travel

The Customer is solely responsible for determining whether they and every traveller included in the booking are medically, physically, mentally, and otherwise fit to undertake the planned travel arrangements.

The Customer must consider the nature of the journey, including flights, cruise travel, sea conditions, excursions, walking distances, stairs, tender transfers, climate, altitude, accessibility, medical facilities, and the availability of medical treatment at sea or in destination ports.

Rarecation Travel does not provide medical advice and does not assess or guarantee a Customer’s fitness or suitability for travel.

13.2 Disclosure of Medical and Accessibility Requirements

Before booking and throughout the journey, the Customer must notify Rarecation Travel in writing of any relevant medical condition, disability, mobility limitation, pregnancy, allergy, dietary requirement, medication requirement, need for medical equipment, need for assistance, or other circumstance that may affect the Customer’s ability to travel safely or use the booked services.

The Customer remains responsible for disclosing such information directly to the relevant cruise line, airline, hotel, tour operator, insurer, or other supplier where required.

Rarecation Travel will use reasonable efforts to pass on requests for special assistance where appropriate, but does not guarantee that any request can be accommodated or that any supplier service is suitable, accessible, or available for the Customer’s needs.

13.3 Medical Clearance and Supplier Requirements

Cruise lines, airlines, insurers, port authorities, and other suppliers may impose health, pregnancy, medical-clearance, vaccination, medication, mobility, accessibility, or fitness-to-travel requirements.

The Customer is solely responsible for obtaining any required medical certificate, doctor’s letter, fitness-to-travel clearance, vaccination record, medication documentation, or other supporting document by the deadline specified by the relevant supplier.

A supplier may refuse boarding, refuse carriage, restrict participation, require medical clearance, require a companion, remove a passenger, or deny access to a service where it considers this necessary for health, safety, operational, or regulatory reasons. Rarecation Travel shall not be responsible for such decisions.

13.4 Medication and Medical Equipment

The Customer is solely responsible for carrying sufficient medication, prescriptions, medical supplies, mobility aids, and medical equipment for the entire journey, including for delays or unexpected extensions.

The Customer must ensure that all medication and equipment comply with the requirements of the relevant airline, cruise line, destination, transit country, and other authority. Rarecation Travel shall not be responsible for any loss, delay, confiscation, unavailability, storage issue, or restriction relating to medication or medical equipment.

13.5 Illness, Injury, Death, and Medical Emergencies

If the Customer suffers illness, injury, a medical emergency, accident, incapacity, hospitalisation, quarantine, evacuation, repatriation, or death during or in connection with the trip, the Customer and/or the Customer’s estate shall be solely responsible for all resulting costs and arrangements, except to the extent covered by insurance or required by applicable law.

Such costs may include, without limitation:

a) onboard medical charges, clinic charges, doctor’s fees, hospital charges, medication costs, ambulance costs, and emergency-treatment costs;

b) medical evacuation, repatriation, air ambulance, transport, accommodation, meals, companion travel, and funeral-related costs;

c) travel changes, rebooking charges, flight costs, cancellation charges, additional accommodation, transfers, and onward-travel costs;

d) costs arising from missed embarkation, early disembarkation, denied boarding, removal from the vessel, or inability to continue the trip; and

e) administrative, communication, translation, legal, insurance-excess, and other related expenses.

Rarecation Travel may, as a courtesy and without obligation, assist in communicating with the Customer’s emergency contact, insurer, or relevant supplier. Such assistance does not create an obligation for Rarecation Travel to arrange, advance, guarantee, pay for, or reimburse any medical treatment, evacuation, repatriation, accommodation, transport, or other service.

13.6 Emergency Contact

The Customer must provide accurate and current emergency-contact details before travel and must ensure that the nominated emergency contact is aware of the nomination.

If a medical emergency, serious illness, injury, incapacity, hospitalisation, evacuation, or death occurs, Rarecation Travel may contact the nominated emergency contact and disclose reasonably necessary information for the purpose of coordinating assistance, subject to applicable privacy laws.

The Customer authorises Rarecation Travel to seek instructions from the emergency contact where the Customer is unable to communicate. However, neither Rarecation Travel nor the emergency contact is obliged to make or fund any arrangement unless separately agreed.

13.7 Insurance

The Customer is strongly advised to obtain and maintain comprehensive travel and medical insurance appropriate for the entire trip. The insurance should include adequate coverage for pre-existing medical conditions, medical treatment, hospitalisation, emergency evacuation, repatriation, trip cancellation, trip curtailment, personal liability, death, and travel disruption.

Rarecation Travel does not provide insurance coverage unless expressly confirmed in writing. The Customer is solely responsible for confirming the scope, exclusions, limits, and claim requirements of any insurance policy.

13.8 Denied Boarding or Inability to Travel for Medical Reasons

If the Customer is denied boarding, denied embarkation, denied participation, removed from a vessel or aircraft, or otherwise unable to travel due to medical, health, pregnancy, fitness, safety, documentation, or supplier requirements, all resulting costs shall be borne solely by the Customer.

The booking shall be treated as a customer cancellation or No Show, as applicable. All payments shall remain subject to Clause 3, Clause 7, the relevant Supplier Terms, and applicable law.

13.9 Limitation of Responsibility

Except where liability cannot lawfully be excluded, Rarecation Travel shall not be responsible or liable for any illness, injury, death, medical condition, medical emergency, medical-treatment decision, medical expense, refusal of carriage, denial of boarding, evacuation, repatriation, travel disruption, or other loss arising during or in connection with the journey.

14. Travel Insurance

14.1 No Insurance Provided Unless Expressly Confirmed

Rarecation Travel does not provide, arrange, act as insurer for, or guarantee travel insurance unless this is expressly stated in writing in the Customer’s booking confirmation or insurance policy documentation.

Any insurance that may be offered or referred to by Rarecation Travel is subject to the terms, conditions, exclusions, limits, eligibility requirements, and claims procedures of the relevant insurer. Rarecation Travel does not determine whether a claim will be approved, paid, or rejected.

14.2 Customer’s Responsibility to Obtain Suitable Insurance

The Customer is strongly advised to obtain and maintain comprehensive travel and medical insurance for the full duration of the journey, from the date of booking until the Customer returns home.

The Customer is responsible for selecting insurance that is suitable for their personal circumstances, travel itinerary, destinations, transit countries, cruise itinerary, planned Shore Excursions, activities, age, health condition, and any pre-existing medical condition.

The Customer should obtain insurance coverage for, where applicable:

a) trip cancellation, curtailment, postponement, and non-refundable booking payments;

b) flight delays, cancellations, missed connections, missed embarkation, and travel disruption;

c) emergency medical treatment, hospitalisation, medication, and medical expenses;

d) emergency evacuation, medical repatriation, air ambulance, and return-home expenses;

e) illness, injury, disability, incapacity, and death during travel;

f) loss, theft, delay, or damage to baggage, passports, travel documents, valuables, and personal belongings;

g) personal liability, legal expenses, and damage caused to another person or property;

h) Shore Excursions, water sports, adventure activities, and any other activity undertaken during the trip; and

i) any other risk, cost, or disruption that may arise during the journey.

14.3 Pre-Existing Conditions and Activity Coverage

The Customer must carefully review the insurance policy before purchase to ensure that it covers all relevant pre-existing medical conditions, pregnancy-related travel, age-related restrictions, planned activities, cruises, destinations, and travel arrangements.

The Customer must disclose all information required by the insurer accurately and completely. Rarecation Travel shall not be responsible for any refusal of insurance coverage, claim rejection, policy exclusion, insufficient coverage, excess amount, or dispute between the Customer and the insurer.

14.4 Customer’s Acknowledgement of Financial Risk

The Customer acknowledges that travel may involve financial risks, including cancellation charges, supplier-service failures, medical emergencies, evacuation, repatriation, missed embarkation, loss of documents, baggage loss, travel disruption, and other unexpected expenses.

If the Customer chooses not to obtain suitable travel insurance, or obtains insurance that does not provide adequate coverage, the Customer accepts full responsibility for all resulting losses, costs, charges, expenses, and liabilities.

Rarecation Travel shall not be responsible for reimbursing, advancing, absorbing, or compensating any uninsured or underinsured loss, expense, medical cost, cancellation charge, travel disruption, or other financial consequence.

14.5 Claims

The Customer is solely responsible for submitting any insurance claim directly to the relevant insurer within the required time and in accordance with the insurer’s procedures.

Rarecation Travel may, as a courtesy and without obligation, provide reasonable booking documents or confirmation details that may assist with an insurance claim. However, Rarecation Travel does not guarantee the outcome, processing time, or approval of any insurance claim.

h) any other circumstance that Rarecation Travel could not reasonably prevent, avoid, overcome, or control.

15.3 Changes, Postponement, or Cancellation of Travel Arrangements

Where a Force Majeure Event occurs, Rarecation Travel and/or the relevant supplier may, without liability, change, shorten, postpone, suspend, reroute, substitute, reschedule, or cancel any part of the travel arrangements.

This may include changes to flights, cruise itineraries, ports of call, embarkation or disembarkation arrangements, accommodation, transfers, tours, excursions, travel dates, routes, vessels, aircraft, or other supplier services.

The Customer acknowledges that such changes may occur with limited or no prior notice where required by safety, operational, regulatory, or emergency circumstances.

15.4 Customer Costs and Responsibilities

The Customer remains responsible for all personal, incidental, and consequential costs arising from a Force Majeure Event, unless the relevant supplier or insurer expressly agrees otherwise in writing.

Such costs may include accommodation, meals, transport, flight changes, fare differences, transfers, visa costs, medical costs, insurance costs, communication costs, baggage costs, quarantine costs, and onward-travel or return-home costs.

Rarecation Travel shall not be required to advance, reimburse, absorb, or compensate any such cost.

15.5 Refunds, Credits, and Alternative Arrangements

Any refund, credit, rebooking, compensation, travel voucher, substitute arrangement, or other remedy arising from a Force Majeure Event shall be subject solely to the applicable Supplier Terms, supplier policy, insurance policy, and applicable law.

Rarecation Travel may, as a courtesy and without obligation, assist the Customer in communicating with the relevant supplier or submitting a request for a refund, credit, rebooking, or alternative arrangement. However, Rarecation Travel does not guarantee that any request will be approved, processed, or paid.

Any supplier-approved refund, credit, or compensation may be subject to deductions, deadlines, restrictions, non-transferability, or other conditions. Rarecation Travel’s administrative, service, consultation, handling, processing, payment, and other non-refundable fees shall remain non-refundable in accordance with Clause 3.

15.6 Notice and Mitigation

Where reasonably practicable, Rarecation Travel will notify the Customer of a material Force Majeure Event affecting the booking using the contact details provided by the Customer.

The Customer must promptly comply with all instructions issued by Rarecation Travel, the relevant supplier, insurer, or authority, and must take reasonable steps to minimise loss, comply with safety requirements, and maintain suitable travel insurance.

15.7 No Liability

Except where liability cannot lawfully be excluded, Rarecation Travel shall not be liable for any injury, illness, death, delay, cancellation, missed connection, missed embarkation, loss of holiday time, loss of enjoyment, loss of property, additional expense, or other loss arising directly or indirectly from a Force Majeure Event.

16. Limitation of Liability

16.1 Rarecation Travel acts solely as an intermediary agent arranging services provided by independent suppliers.

16.2 Rarecation Travel shall not be liable for injury, loss, delay, inconvenience, or damages caused by suppliers, weather, government actions, or operational disruptions.

16.3 Passengers participate in travel at their own risk.

16.4 Rarecation Travel shall not be responsible for indirect or consequential damages including loss of enjoyment or vacation time.

16.5 The total liability of Rarecation Travel shall not exceed the service fees received for the booking.

17. Data Protection

17.1 Rarecation Travel may collect and process personal data necessary to arrange travel services.

17.2 This may include passport information, contact details, travel preferences, dietary requirements, or limited health information.

17.3 Such data may be shared with suppliers, insurers, or authorities where required.

18. Complaints and Dispute Resolution

18.1 Customers must submit complaints through Rarecation Travel official communication channels.

18.2 Complaints should be submitted within thirty (30) days after completion of travel.

18.3 Rarecation Travel will review and respond within a reasonable timeframe.

18.4 Customers must not publish false or defamatory statements intended to damage the reputation of Rarecation Travel.

19. Photography, Video and Marketing Use

19.1 Photography and Video During Travel

Rarecation Travel, its representatives, tour leaders, photographers, videographers, and authorised service providers may take photographs, videos, audio recordings, livestreams, or other visual content during travel, including at airports, ports, onboard vessels, hotels, Shore Excursions, group activities, events, and other travel-related locations (“Media Materials”).

Media Materials may include the Customer’s image, likeness, voice, name, or participation in group activities.

19.2 Consent to Use Media Materials

By participating in the trip, the Customer grants Rarecation Travel a non-exclusive, worldwide, royalty-free right to use, reproduce, edit, publish, display, distribute, and share Media Materials containing the Customer’s image, likeness, voice, or participation for Rarecation Travel’s legitimate business, promotional, marketing, advertising, social-media, website, brochure, presentation, and publicity purposes.

Rarecation Travel may use Media Materials in printed, digital, online, social-media, video, and other current or future media formats.

Rarecation Travel will use reasonable efforts to ensure that Media Materials are used in a respectful and appropriate manner. However, Rarecation Travel does not guarantee that the Customer will not appear incidentally in group photographs, videos, or other Media Materials.

19.3 Opt-Out Request and Customer Cooperation

A Customer who does not wish for their identifiable image, likeness, or voice to be used for Rarecation Travel’s marketing or promotional purposes must notify Rarecation Travel in writing before travel.

Following a valid opt-out request, Rarecation Travel will use reasonable efforts to instruct its crew and representatives not to intentionally capture or use identifiable Media Materials of that Customer for marketing purposes. However, the Customer acknowledges that travel involves group settings, public areas, events, excursions, and spontaneous activities where it may not be reasonably possible to prevent the Customer from appearing incidentally in photographs, videos, background footage, group content, or live recordings.

The Customer is responsible for reasonably identifying themselves to Rarecation Travel’s crew or representative where practical and for avoiding cameras, photographers, videographers, and group-photo areas where they do not wish to be captured. Rarecation Travel shall not be responsible for incidental or unavoidable capture of the Customer in Media Materials despite reasonable efforts.

Where the Customer knowingly participates in, poses for, or voluntarily remains in a photograph, video, group activity, interview, or recording after having made an opt-out request, Rarecation Travel may reasonably treat that participation as consent for the use of the relevant Media Materials, unless the Customer clearly states otherwise at that time.

An opt-out request does not require Rarecation Travel to remove or withdraw Media Materials that have already been published, printed, distributed, shared with third parties, or otherwise used before the request is received, except where required by applicable law.

19.4 Children and Minors

Where a traveller is under the age of majority, the parent, legal guardian, or person authorised to make the booking on the minor’s behalf confirms that they have authority to provide consent for the minor’s participation in Media Materials.

A parent or legal guardian who does not wish for a minor’s identifiable image or voice to be used must submit an opt-out request to Rarecation Travel in writing before travel.

19.5 No Compensation or Ownership Rights

The Customer acknowledges that no payment, royalty, fee, compensation, approval right, or other benefit shall be payable for Rarecation Travel’s use of Media Materials in accordance with this clause.

The Customer waives any right to inspect or approve the final version, editing, captioning, publication, distribution, or use of Media Materials, provided that Rarecation Travel uses them in accordance with this clause and applicable law.

19.6 Third-Party and Supplier Content

Rarecation Travel is not responsible for photographs, videos, recordings, livestreams, or other content captured, published, or used by cruise lines, airlines, hotels, tour operators, local operators, other travellers, members of the public, or other third parties.

Such third-party content is subject to the relevant third party’s policies, terms, and privacy practices.

19.7 Privacy Rights

This clause is subject to applicable privacy and data-protection laws. Any request concerning the use of the Customer’s personal data or identifiable Media Materials may be submitted to Rarecation Travel in writing using its published contact details.
